Fearrington Swim & Croquet Club, Inc.  RELEASE AND INDEMNITY AGREEMENT  I, ______________________________, in consideration of being permitted to participate in  the exercise activities and programs, either inside or outside of the pool, sponsored by  the Fearrington Swim & Croquet Club, Inc. (hereinafter known as "The Club" and, where  referenced, "The Club" shall include its officers, directors, members, agents, employees,  volunteers, instructors, and activity leaders) do hereby fully and unconditionally release  and forever discharge "The Club" from any and all responsibility and liability for injuries  and damages resulting or arising from my participation in such exercise activities and  programs.  I am aware that exercise activities are potentially hazardous and may involve a risk of  injury or harm. I understand and am aware that "The Club' does not require the exercise  instructors or activity leaders to be professionally trained, certified, or licensed in  exercise, physical fitness, physical therapy, aqua aerobics, CPR, or First Aid. I am  voluntarily participating in these activities with knowledge of the risks involved and the  aforementioned status of the exercise instructors and activity leaders. I acknowledge  that I have familiarized myself with the condition of the pool and the premises used in  the exercise activities. I hereby agree to assume and hereby expressly accept any and  all responsibility for risks of injury, harm, and damages resulting or arising from my  participation in exercise activities and programs sponsored by "The Club" and the use of  its facilities and equipment.  I do hereby further declare myself to be in good health and to have no known medical  or physical condition that might pose an unreasonable risk of harm either to myself or to  other members of the exercise class. I do hereby acknowledge that I am required to  submit a physician's written approval prior to my participation in any exercise activity  sponsored the "The Club". By participating in the exercise activities, I am acknowledging  that I have been given my physician's permission to participate.  This Agreement shall be fully binding upon my executors, administrators, personal  representatives, collectors, heirs, successors, and assigns, and shall inure to the benefit  of "The Club" and all of its past, present, and future officers, directors, employees,  agents, representatives, volunteers, instructors, activity leaders, and their successors.  I further promise to indemnify “The Club” against any and all claims or suits of any  nature or description that may in the future be brought by any person or entity on  account of injuries or damages arising out of my participation in exercise activities and  use of the facilities of “The Club” for the above described purposes. This indemnity  provision shall include the costs of mediation and litigation, reasonable attorney fees, and the payment of any damages whether by settlement or judgment.  ______________________________ ________________ __________________________ Signature of Participant Date
